A wrongful death case is a type of personal injury claim in which the offender
is held responsible for the pain and suffering that he or she has caused the
family of the victim. In a wrongful death lawsuit the family members of the
deceased may seek compensation for damages as a result of the defendant's negligence.
In order to file a wrongful death claim, a person must have
died as the result of the defendant's negligent behavior. There
also must be a family member, such as a child or spouse, or a dependent
who can make a claim to recover damages for the loss of his or her
loved one.
Every state has a different "statute of limitations"
which is a guideline for how long individuals have to file certain
kinds of lawsuits. The timeline for filing a wrongful death claim
typically begins following the death of the victim. Statutes of
limitations have different provisions which make certain exceptions
which may alter the amount of time that you have to file a claim.
Your claim could be denied if you don't file it within the given
time.
